These Terms of Service (“Terms”) are a binding agreement between you and Play Fast Motion LLC, an Ohio limited liability company doing business as PlayFast Motion (“PlayFast,” “we,” “our,” or “us”). By accessing or using the PlayFast Motion application, website, hardware sensor, and related services (collectively, the “Service”), you agree to be bound by these Terms and by our Privacy Policy, Hardware Warranty, and Return and Refund Policy, each of which is incorporated into these Terms by reference. If you do not agree to these Terms, do not use the Service.
These Terms contain a binding individual arbitration agreement and a class action waiver in Section 16. They affect your legal rights. Please read them carefully.
You must be at least 13 years old to create an account or use the Service. The Service is a general-audience product. It is not directed to children under 13, and children under 13 are not permitted to create an account or use the Service. We do not knowingly collect personal information from anyone under 13. If we learn that we have collected personal information from a child under 13, we will delete it. If you believe a child under 13 has provided us with personal information, contact us at support@playfastlax.com.
If you are between 13 and 17 years old (or otherwise a minor where you live), you may use the Service only with the involvement and permission of a parent or legal guardian who has reviewed and agreed to these Terms on your behalf. By using the Service as a minor, you confirm that your parent or legal guardian has given that permission. A parent or legal guardian who allows a minor to use the Service agrees to these Terms on the minor's behalf, is responsible for supervising the minor's use, and is responsible for all activity under the account.
PlayFast Motion provides a lacrosse training system consisting of:
We may change, suspend, or discontinue any part of the Service at any time. We are not liable to you or any third party for any change to, suspension of, or discontinuation of the Service.
To use certain features of the Service, you must create an account. You agree to:
Lacrosse training is a strenuous physical activity that carries inherent risks, including the risk of serious bodily injury, permanent disability, or death. These risks can come from the activity itself, from equipment, from playing surfaces, from other people, and from your own physical condition. The PlayFast Service offers training and fitness information for educational and informational purposes only. It is not medical advice, and it is not a substitute for professional medical advice, diagnosis, or treatment.
You should consult a physician or other qualified healthcare provider before beginning or changing any training or exercise program, especially if you have any medical condition or have ever been advised to limit your physical activity. By using the Service, you affirm that you (or, for a minor, the athlete) are in good physical health and have no medical condition that would make training unsafe, or that you have obtained a healthcare provider's approval to train. Stop immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any other symptom during training.
To the fullest extent permitted by law, you knowingly and voluntarily assume all risks of injury, harm, or loss arising from your use of the Service and from any training, drills, or physical activity you perform, whether those risks are known or unknown. If you allow a minor to use the Service, you (the parent or legal guardian) assume these risks on the minor's behalf. This Section does not waive any liability for death or personal injury caused by our own negligence, or any liability that cannot be limited or excluded under applicable law (see Section 14).
The Service estimates performance metrics such as throw speed (mph), shot and rep counts, power scores, streaks, and leaderboard rankings using sensor data and software algorithms. These metrics are estimates for training and entertainment purposes only. They are not exact measurements, may be inaccurate or incomplete, and may differ from radar guns, scouting tools, or other measurement systems.
You should not rely on these metrics for any medical, safety, recruiting, scholarship, competitive ranking, wagering, or other consequential decision. We do not warrant that any metric is accurate, reliable, or fit for any particular purpose.
Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to the collection and use of information as described there. We collect workout and training data to provide the Service. Additional data sharing (such as leaderboard participation or contributing data to improve our algorithms) requires your explicit opt-in consent.
You retain ownership of any content you submit to the Service. By submitting content, you grant PlayFast a non-exclusive, worldwide, royalty-free license to use, host, store, display, and process that content for the purpose of operating and providing the Service.
You agree not to:
PlayFast Pro is a recurring subscription that unlocks guided routines, leaderboards, progress analytics, full workout history, and coach visibility. The default plan is monthly at $17.99/month. An annual option is available at $99.99/year ($8.33/month equivalent) and can be activated from inside the app after the free trial.
Each customer is eligible for one 14-day free trial of PlayFast Pro. The trial is activated when you sign into the iOS app for the first time after purchasing the PlayFast sensor on this website. The trial does NOT begin at the time of hardware purchase. If you cancel before the trial ends, you will not be charged.
When the free trial ends, your subscription automatically converts to the paid monthly plan and your saved payment method is charged $17.99. Subscriptions automatically renew at the end of each billing period (monthly or yearly) at the then-current price until cancelled. By subscribing, you authorize us and our payment processor to charge your payment method on a recurring basis until you cancel.
You can cancel at any time from the app or your account page on this site, and cancelling is as easy as subscribing. Cancellation stops future renewals. You retain access through the end of your current billing period. We do not pro-rate or refund partial months. Annual subscriptions can be cancelled but are not refunded for unused months.
If a renewal payment fails (expired card, insufficient funds, etc.), your account moves to the Free plan, wall ball rep counter and current-session speed only, until you update your payment method. Your account is not deleted; you can restore Pro features at any time by adding a working card.
Refunding or returning your PlayFast sensor does not automatically cancel your PlayFast Pro subscription, and vice versa. The two are billed and managed separately. To cancel your subscription, use the in-app cancel option or your account page. To return hardware, see the Return and Refund Policy.
All payments are processed by Stripe, Inc. We do not store your full card number on our servers. By making a purchase you also agree to Stripe's terms of service. If you subscribe through Apple, the Apple App Store's billing, auto-renewal, and cancellation terms also apply.
The PlayFast Motion sensor device and any other physical goods are subject to our Hardware Warranty and our Return and Refund Policy. Use of the device during training is at your own risk. By using the device, you agree to those policies.
The Service, including the application, website, hardware design, firmware, software, text, graphics, logos, and the PlayFast and PlayFast Motion names and marks, is owned by PlayFast or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms. We reserve all rights not expressly granted. If you believe content on the Service infringes your copyright, contact us at support@playfastlax.com.
EXCEPT AS EXPRESSLY STATED IN OUR HARDWARE WARRANTY, THE SERVICE AND THE DEVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR ACCURATE. PlayFast is not responsible for any injuries that may occur during training. Always consult a healthcare provider before beginning any exercise program.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLAYFAST AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless PlayFast and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and costs (including reasonable attorneys' fees) arising from or relating to (a) your use of the Service, (b) your breach of these Terms, (c) your violation of any law or the rights of any third party, or (d) the use of the Service by a minor for whom you are the parent or legal guardian.
You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or for any other lawful reason. Sections that by their nature should survive termination (including Sections 5, 6, 11 through 16, and 18 through 20) will survive.
Please read this Section carefully. It affects your legal rights, including your right to file a lawsuit in court.
Informal resolution first. If you have a dispute with us, you agree to first contact us at support@playfastlax.com and give us 30 days to resolve it informally before starting an arbitration or lawsuit.
Binding arbitration. Except as stated below, you and PlayFast agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this Section.
JURY AND CLASS ACTION WAIVER. YOU AND PLAYFAST EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY. If a court decides that this class action waiver is unenforceable as to a particular claim, that claim (and only that claim) will be severed and may proceed in court.
30-day right to opt out. You may opt out of this arbitration agreement by sending written notice to support@playfastlax.com within 30 days of first agreeing to these Terms. The notice must include your name and the email associated with your account and state that you opt out of arbitration. If you opt out, neither you nor PlayFast can require the other to arbitrate.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property rights.
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. For any dispute that is not subject to arbitration, you and PlayFast agree to the exclusive jurisdiction and venue of the state and federal courts located in the State of Ohio.
You consent to receive communications from us electronically, including by email and through the Service. Electronic communications and records satisfy any legal requirement that a communication be in writing.
We are not liable for any failure or delay in providing the Service caused by events beyond our reasonable control, including acts of God, natural disasters, power or internet failures, labor disputes, supply shortages, or actions of third-party service providers.
Entire agreement. These Terms, together with the Privacy Policy, Hardware Warranty, and Return and Refund Policy, are the entire agreement between you and PlayFast regarding the Service and supersede any prior agreements.
Severability. If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the rest of the Terms will remain in full force.
Assignment. You may not assign or transfer these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or otherwise.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes take effect means you accept the updated Terms.
